What is the EB-5 Immigrant Investor Program?

Simply put it’s a Program whereby Foreign Nationals can Invest in U.S. government approved Commercial Enterprises to receive their Green Card and eventual Citizenship.
The following information comes directly from the U.S. Citizenship and Immigration Services (USCIS) website.

EB-5 Immigrant Investor

Visa Description

USCIS administers the Immigrant Investor Program, also known as “EB-5,” created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. Under a pilot immigration program first enacted in 1992 and regularly reauthorized since, certain EB-5 visas also are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.
All EB-5 investors must invest in a new commercial enterprise, which is a commercial enterprise:
  • Established after Nov. 29, 1990, or
  • Established on or before Nov. 29, 1990, that is:
    1. Purchased and the existing business is restructured or reorganized in such a way that a new commercial enterprise results, or
    2. Expanded through the investment so that a 40-percent increase in the net worth or number of employees occurs
Commercial enterprise means any for-profit activity formed for the ongoing conduct of lawful business including, but not limited to:
  • A sole proprietorship
  • Partnership (whether limited or general)
  • Holding company
  • Joint venture
  • Corporation
  • Business trust or other entity, which may be publicly or privately owned
This definition includes a commercial enterprise consisting of a holding company and its wholly owned subsidiaries, provided that each such subsidiary is engaged in a for-profit activity formed for the ongoing conduct of a lawful business.
Note: This definition does not include noncommercial activity such as owning and operating a personal residence.

Job Creation Requirements

  • Create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years (or under certain circumstances, within a reasonable time after the two-year period) of the immigrant investor’s admission to the United States as a Conditional Permanent Resident.
  • Create or preserve either direct or indirect jobs:
    • Direct jobs are actual identifiable jobs for qualified employees located within the commercial enterprise into which the EB-5 investor has directly invested his or her capital.
    • Indirect jobs are those jobs shown to have been created collaterally or as a result of capital invested in a commercial enterprise affiliated with a regional center by an EB-5 investor. A foreign investor may only use the indirect job calculation if affiliated with a regional center.
Note: Investors may only be credited with preserving jobs in a troubled business.
troubled business is an enterprise that has been in existence for at least two years and has incurred a net loss during the 12- or 24-month period prior to the priority date on the immigrant investor’s Form I-526. The loss for this period must be at least 20 percent of the troubled business’ net worth prior to the loss. For purposes of determining whether the troubled business has been in existence for two years, successors in interest to the troubled business will be deemed to have been in existence for the same period of time as the business they succeeded.
qualified employee is a U.S. citizen, permanent resident or other immigrant authorized to work in the United States. The individual may be a conditional resident, an asylee, a refugee, or a person residing in the United States under suspension of deportation. This definition does not include the immigrant investor; his or her spouse, sons, or daughters; or any foreign national in any nonimmigrant status (such as an H-1B visa holder) or who is not authorized to work in the United States.
Full-time employment means employment of a qualifying employee by the new commercial enterprise in a position that requires a minimum of 35 working hours per week. In the case of the Immigrant Investor Pilot Program, “full-time employment” also means employment of a qualifying employee in a position that has been created indirectly from investments associated with the Pilot Program.
job-sharing arrangement whereby two or more qualifying employees share a full-time position will count as full-time employment provided the hourly requirement per week is met. This definition does not include combinations of part-time positions or full-time equivalents even if, when combined, the positions meet the hourly requirement per week. The position must be permanent, full-time and constant. The two qualified employees sharing the job must be permanent and share the associated benefits normally related to any permanent, full-time position, including payment of both workman’s compensation and unemployment premiums for the position by the employer.

Capital Investment Requirements

Capital means cash, equipment, inventory, other tangible property, cash equivalents and indebtedness secured by assets owned by the alien entrepreneur, provided that the alien entrepreneur is personally and primarily liable and that the assets of the new commercial enterprise upon which the petition is based are not used to secure any of the indebtedness. All capital shall be valued at fair-market value in United States dollars. Assets acquired, directly or indirectly, by unlawful means (such as criminal activities) shall not be considered capital for the purposes of section 203(b)(5) of the Act.
Note: Investment capital cannot be borrowed.
Required minimum investments are:
  • General. The minimum qualifying investment in the United States is $1 million.
  • Targeted Employment Area (High Unemployment or Rural Area). The minimum qualifying investment either within a high-unemployment area or rural area in the United States is $500,000.
targeted employment area is an area that, at the time of investment, is a rural area or an area experiencing unemployment of at least 150 percent of the national average rate.
rural area is any area outside a metropolitan statistical area (as designated by the Office of Management and Budget) or outside the boundary of any city or town having a population of 20,000 or more according to the decennial census.

A Start-up means “Start”!

There are many people out there starting New Businesses giving their Gifts to the World and this is definitely a great time to do so. I run into would be Entrepreneurs all the time who have a great idea, but have not made it a reality because they say they need a certain amount of cash to get it off the the ground. Often times not having the Cash is an “excuse” not to take the next step on your journey, ask yourself if you lost your job what would you do today to make your business real.

This brings me to the title of this post:

A Start-up means “Start”!

The key point is the definition of “Start” and your definition may mean: writing your idea down on paper, writing a business plan, getting business cards, telling people about you great world changing idea or any other “preparations”. My definition of “Start” is bringing in the CASH for Your Idea because you are in business to provide value to your customers who in turn gladly give you their appreciation in the form of Money! If you concentrate on providing value to your customer and getting that 1st check things start to change in your favor rather rapidly. I myself reserved the name Acquisitionist.com about 6 years ago but did not concentrate on receiving that 1st payment and as a result nothing happened even thou I had a website (no contact info thou???). Once I recommitted myself to helping as many people as possible by getting the word out and actually helping people Acquire what they Desire the cash “Started” rolling in within weeks.

What are you waiting for…

Yesterday I crashed a Business Networking event (highly recommend this) and met a beautiful young lady who was working for a company looking to expand overseas. I asked her about her ideal business and she rattled it off with the quickness and then I asked her why she wasn’t doing it, her reply was she had to do more research. At this point I couldn’t help myself as whenever there is a damsel in distress Alphonse is at his best, well I gave her a few suggestions and committed to assisting her in her endeavors.

The reason I’m telling this story is that we often don’t realize that we are the only ones delaying what we were put on this planet to do and once we ask the question “What am I waiting for?” we will realize that the reasons are really just illusions. I reserved the name Acquisitionist.com over 6 years ago and put up a simple web page but “no contact information”, I don’t know why I didn’t allow people to contact me I may have been scared or not really had the confidence in my abilities but it goes back to (What was I waiting for?).

We all want it, but fear it at the same time…

“Change”

We want to change the way we look, our weight, our jobs, our relationships and a whole assortment of other things! The Problem we run into is that the majority of us “FEAR” change and end up doing nothing about it thus becoming frustrated and often depressed or complacent. I read a little e-book last night that reminded me of a little secret that I had received from GOD Herself several years ago.

At first I was like, “Yeah OK whatever” then I started to think about it every day and it became crystal clear: everything that has happened in my life has mostly been the result of my choices based on what I “know”, if I “Change” my choices and walk boldly into the unknown I “change” my life!

When we were children “Change” was a way of life, we just wanted to discover what this blue ball had to offer and an example is thou we all had a little fear about learning something new the majority of us learned to ride a bike. The same thing goes for our ideal weight, job, business and/or relationships we have to move forward one step at a time and embrace the “Unknown” and we will see and become the “Change” we seek in our lives.

It’s OK to fear change, but once you take that 1st step and take a step EVERY DAY the fear simply goes away. World Domination?

Reading the Website/Blog by Chris Guillebeau inspired me to get my website up and running in 24 hours, I also must say getting kicked in my left testicle by my friend Reggie revealing that I had reserved the name “Acquisitionist” 6 years ago and didn’t follow through was added motivation.

Chris’ article about starting a Consulting Business with the Quickness was the beginning, but I continued to read and realized the only thing holding me back from where I truly wanted to be was myself. He just had a conference with 1000 liked minded individuals who are doing amazing things by utilizing their Gifts and following their Passions, I will be there next year.

An Amazing Device: “The Phone”

Last week I was sitting down with a Gentleman in a hotel lounge and he freely gave me some of his business wisdom that allowed him to build a company and sell it so he could retire or basically do whatever he wants. He is not a young buck by any means and I was honored to hear how he built an empire by building relationships with “People”. I shared with him how I have great Success by talking to People on the phone and he said that every business person should have that skill. Some of you may be saying that “It’s easy for you,  I have trouble remembering my name when I’m on the phone”, well I got news for you when I started I was scared to. When I got into Real Estate Wholesaling many moons ago I took everything personally that someone said to me, but I kept going and an amazing thing happened (Started to make Cash Money).

Just remember when you’re on the phone you’re looking to help the other person, don’t focus on what’s in it for you because people can sense when you’re in their corner. So, pick up that phone are start asking “People” how you can help them!

That Old Success Secret “Consistency”!

This is a BIG one to acknowledge because we often don’t want to face the results that have emerged in our life from a simply concept called “Consistency”. Take an area in your life that you have a few challenges with say you’re over weight, guess what “Consistency” got you there and “Consistency” can get you to your ideal weight. Now you may be saying I’m full of Crap, but we become over weight by consistently eating the wrong foods and consistently not properly exercising. We become over weight by consistently doing those things that make us over weight, I know it’s a tough pill to swallow. About 2 years ago I looked in the mirror and said, damn you’re a fat f%*k and you need to do something about it. I prayed to God and said please send me something I can do every day that does not take a lot of time that will give me the results I desire, soon I was online and found the “5 Tibetan rites” and I’m not a fat f%*k anymore (2 years of Consistency). What is your Independence Day?

As we prepare for Independence Day I’m reminded of a choice I made back in 1997 to leave my J.O.B. working for a company that rhymes with “Stinkos”. I purposely aligned my exit with Independence Day because I wanted to remind myself every year that I had the courage to step out into the unknown and achieve my Freedom. Most of the years have been superb with a few challenging ones thrown in, but I would not change a thing because it has been a fabulous journey that continues to this day.

So I ask you what and when is your Independence Day, when are you going to be free from:

  • A Bad relationship
  • Dead End Job
  • Bad Attitude
  • Low Self Esteem
  • Judging Others
  • Inferior Health
  • Hatred
  • Anger
  • Your Comfort Zone

As the Acquistionist I specialize in helping others acquire what they desire and I have discovered that we often have all we desire within reach if we just take a moment to free ourselves from our own self imposed limitations as those I’ve mentioned above.
